When a company uses HR software published by an American company, its data — salaries, sick leave, evaluations — may be subject to the Cloud Act. This 2018 American law authorizes authorities to access data held by American companies, regardless of where it is hosted.

This extraterritoriality creates an incompatibility with GDPR, which strictly regulates the transfer of personal data outside the European Union. For HR data, among the most sensitive in a company, this situation represents a real legal risk.
